Minutes of the regular meeting of the Borough of Newtown Board of Burgesses on Tuesday, August 9, 2011 at Edmond Town Hall, Newtown, CT. Warden Gaston called the meeting to order at 7:35 p.m.

Present: Warden James Gaston, Second Senior Burgess Jay Maher, Burgess Anthony Baiad, Burgess Bill Lucas, Burgess Betsy Kenyon, Clerk Ann Benore, Tax Collector Jodie Enriquez, Zoning Officer Jean St. Jean

Absent:  Senior Burgess Joan Crick, Treasurer and Burgess Marie Walker

Also Present:  Tree Warden Rob McCulloch (8:39 p.m.)

Burgess Baiad made a motion to accept the July 12, 2011 meeting minutes, seconded by Second Senior Burgess Maher and unanimously approved.


Public Participation:  None.


Warden’s Report: Warden Gaston reported that no decision has been made yet regarding the Greenridge water project and whether it will completed by United Water or Aquarion.  The final briefs are due August 18th.


Tree Warden’s Report:  Tree Warden Rob McCulloch reported work on two dead elm trees at 11 Currituck Road and removal of trees on Hall Lane.  He also reported that the pruning list is being finalized.


Tax Collector's Report: Tax Collector Enriquez reported the amended End of Fiscal Year June 2011 report:  Total Taxes Due for the List of 2009: $168,497.50; Current Taxes: $165,526.73; Back Taxes: $3,422.59; Interest: $2,266.08; Lien Fees: $528.00; Return of Overpayments ($3,493.31); Total Submitted to Treasurer to Date: $168,250.09; Current Taxes Collected: $162,033.42; Total Carryover for Credit: ($488.12); Jeopardy Payments to be applied 7/1/2011: $475.12; Credits for Overpayments of Taxes: $13.00; Back Tax Outstanding for Lists 2008 & Prior as of June 30, 2011: $4,233.24 (21 properties).

Burgess Kenyon made a motion to accept the End of Fiscal Year June 2011 Report, seconded by Burgess Lucas and unanimously approved.

Tax Collector Enriquez reported the following for July 2011:  Total Taxes Due for the List of 2010: $168,543.73; Current Taxes: $100,770.85; Back Taxes: $1,904.01; Interest: $453.76; Lien Fees: $216.00; Return of Overpayments: ($534.62); Total Submitted to Treasurer to Date: $102,800.00; Current Taxes Collected: $100,236.23.

Burgess Kenyon made a motion to accept the July 2011 Tax Collector’s Report, seconded by Second Senior Burgess Maher and unanimously approved.

Treasurer’s Report: In the absence of Treasurer Marie Walker, Clerk Ann Benore reported the following: A deposit of $61,800.00 was made in July from Tax Collector Jodie Enriquez.  Also a deposit of $45,000.00 was made for August from Tax Collector Enriquez which totals $106,800.00 to date.  A transfer was made of $28,000.00 to cover this month’s invoicing making a total of $300,637.33 in the NSBMM account as of August 9, 2011.  Capital Reserve is $1,899.12 as of July 31, 2011.

Burgess Baiad made a motion to accept the Treasurer’s Report, seconded by Burgess Lucas and unanimously approved.


Zoning Officer’s Report:  Zoning Officer St. Jean reported on the United Water Company/Aquarion project.  Warden Gaston suggested that Attorney Don Mitchell include a timeline of the two proposals in his letter to the DPUC.  Zoning Officer St. Jean presented the Board with the Plan of Conservation Development that includes a mandatory section regarding the Borough.  She asked that all the Burgesses review the document and submit any input.  Discussion followed.


Historic District: Burgess Kenyon reported that the 16 Main Street residence has submitted a proposal for a 2 car garage with finished loft.


Sidewalks: Second Senior Burgess Maher reported that a grant is being submitted by the Board of Selectmen to the federal government for $500,000 for sidewalks on Queen Street as part of the “Safe Path to School” project.


Streets & Parks: Second Senior Burgess Maher reported that the bench at 43 Main Street has been removed and is scheduled for restoration.  He also reported that he looked into the sidewalk work at 32 Main Street and the cost would be approximately $9,000.00.

Burgess Baiad made a motion to have the sidewalk work at 32 Main Street completed, Burgess Kenyon seconded the motion and unanimously approved.

Old Business:  Burgess Kenyon thanked Tree Warden Rob McCulloch for following up with the State regarding removal of the tree on her property.


New Business:  None.

Public Participation: None.

The Annual Meeting of the Board of Burgesses will be held on September 13, 2011 at 7:30 p.m. in the Borough Office at Edmond Town Hall (45 Main Street).        

There being no further business, Burgess Lucas made a motion to adjourn the meeting at 8:58 p.m., seconded by Burgess Baiad and unanimously approved.
